Facts

Petitioner brought a petition against respondent, challenging the return of the 1st respondent as duly elected Governor of Gongola State.

The petitioner chal¬lenged the authenticity of the result sheets and raised various allegations of electoral malpractices. And ironically wanted the same result to form the basis of his been declared the winner.

The petition was dismissed in the High Court, and the appeal To the Federal Court of Appeal was also dismissed. The petitioner thereupon appealed to the Supreme Court.
